Selling a Rented San Diego Home From Out of Town

Kept your San Diego home as a rental after you moved? How to sell it from out of town with the tenant in place, and how restoring VA entitlement fits in.

SELLING FROM A DISTANCE · OCTOBER 2026

Many veterans and service members keep the San Diego house as a rental when they move, and a few years later decide it is time to sell. Doing it from another state with a tenant still living there is common and manageable. This guide covers showings with a tenant, signing from afar, the tax questions that come with a former home, and restoring your VA entitlement once it is sold.

Wondering whether to sell now or keep collecting rent? Take the Home Strategy Quiz: four questions about your plans, answered with a personal plan from Rudy.

The long-distance sale, step by step

  1. Talk through the plan. A phone or video call covers your goals, the lease dates and timing, along with a home value review built on nearby sales.
  2. Electronic listing paperwork. Read the listing agreement and disclosures, ask your questions, then e-sign them.
  3. Prep around the tenant. A video tour, with your tenant's OK, becomes a short list of repairs.
  4. Showings on notice. Each showing needs written notice to your tenant first; ask Rudy how showings, including the busy first days on the market, would run without you present.
  5. Offers and the contract. You e-sign the purchase contract from wherever you live; ask Rudy how offers would be presented and how visits from the inspector and appraiser would be timed around your tenant.
  6. Closing from your new home. Sign the deed in front of a notary near you; escrow explains how the tenant's deposit and the lease are handled.

Your planner and checklist

Pick your situation and the checklist shows only the steps that apply, with the tenant and VA items included. Use the worksheet to total trips, hired work and empty months, and carry it into the selling calculator.

How the signing works when you live elsewhere

An electronic signature has the same legal force as a pen signature in California (Civil Code 1633.7), so nearly all of the paperwork travels by e-sign.

Only the deed needs a notary, since the recorder accepts it only once it has been acknowledged (Government Code 27287). See the table for how that works where you live.

Deed signing routes, by location
Your locationThe usual route for the deed signatureA good question for escrow
Elsewhere in the U.S.Sign before a notary where you live, mobile or in an office; California recognizes an acknowledgment made under that state's law (Civil Code 1189(b)).Will you send a notary, or should I book my own, and how do the originals travel?
Another countryA U.S. consular officer or consular agent, or a local notary followed by an authentication such as an apostille (Civil Code 1183).What identification do you need from me, and how much shipping time should we allow?
Serving on active dutyA commissioned officer with notary powers may take the acknowledgment for a service member or spouse (Civil Code 1183.5).Can you record a deed acknowledged by a military notary?
Over the internetCalifornia notaries cannot yet notarize online (the rule as of October 2026); escrow and the title company decide whether an out-of-state online notarization is acceptable for this deed.Would you accept an online notarization from another state before I set one up?

A legal assistance office can draw up a military power of attorney for free, but banks and title companies may insist on their own forms (Military OneSource). Civilians should ask an attorney. Either way, clear it with the title company before it is used.

Keys, remotes and house notes

Your property manager or tenant may hold most keys. Confirm the full count, including garage openers, the mailbox key and any fobs, and keep a note of shut-offs and the alarm code.

If keys need to travel, ask Rudy where to send them first; tracked overnight shipping, a courier or a trusted friend can carry them.

Prep work without the travel

With a tenant at home, prep tends to be light: touch-up repairs, a cleaning before photos and yard care.

Pick the vendors yourself and approve every quote in writing before work begins. Have the handyman confirm the water heater is braced and the smoke and carbon monoxide detectors work, since the disclosures ask about each.

Seeing the house by video

With your tenant's OK, a live video walk-through gives you a current look at the house without a flight.

Vacant, leased or occupied: what changes

Selling with a tenant in place is one option; the table compares it with an empty house and one where someone you know lives.

Already working with a property manager? They need a valid, active DRE license to collect rent and manage for you, and the DRE license lookup confirms it. To weigh keeping the rental against selling, try the keep or sell calculator and the rental yield by ZIP code table.

Bills, coverage, mail and the Assessor

Check the lease for which utilities your tenant pays. Anything still in your name with SDG&E can be ended or moved on its website, guest option included, and for water and trash, call the provider printed on the bill.

Confirm with your insurer that the policy still fits a rented home. If the homeowners' exemption is still on the tax bill from when you lived there, contact the San Diego County Assessor; December 10 is the cutoff for ending it with no penalty.

Forward your mail through USPS for 12 months; the service needs 7 to 10 business days to kick in.

Photos and staging

With a tenant's furniture in place, staging is mostly decluttering. If the home is empty between leases, labeled virtual staging works when the original photo stays available, as AB 723 requires and the San Diego MLS has enforced since January 1, 2026.

The final week, handled remotely

Schedule the signing a few days ahead of closing, end any utilities in your name on the closing date, and settle with Rudy where keys and remotes go for the buyer. Escrow will walk you through what happens to the tenant's deposit and the lease, and the closing statement is worth keeping.

The home-sale exclusion, worth as much as $250,000 of gain or $500,000 on a joint return, counts the time you actually lived there: 2 years out of the 5 before the sale (IRS Publication 523). A long stretch as a rental can push the years you lived there outside that 5-year window. Service members on qualified official extended duty (orders over 90 days, at least 50 miles away) may be able to suspend the 5-year period for up to 10 years. Under FTB Form 593, escrow may withhold part of the sale price for state tax when no exemption applies. A tax professional can run your dates.

Selling is also the usual path to getting your VA entitlement back. When the sale has closed and the VA loan balance is gone, ask for restoration online or by mailing VA Form 26-1880. That request comes after closing as its own step, and your lender can tell you how long it usually runs.

Selling now versus renting it out

Still deciding between selling and holding the rental? The worksheet total goes to the compare my selling options calculator as both preparation amounts. Keep in mind that its rent-first column counts Repairs and preparation as well, so reduce it there if you would not pay these costs twice. The seller net proceeds estimator, a cash offer and the tax exclusion estimator fill in the rest.

Quick answers

Can I sell my rented San Diego home without flying back?

Most owners in your spot can. Showings can go ahead with proper notice to the tenant, and so can the inspection and the appraisal, without you there. Your part is the signatures, and escrow lays out how each document gets signed.

Living in another state now, how would I sign the deed?

A notary where you live takes the acknowledgment, mobile or in an office, and California accepts it. Service members and spouses can also use a military legal office notary. Overseas, a U.S. consular officer handles it. Escrow will say what ID to bring.

Can the deed be notarized online?

California notaries cannot notarize online yet. Whether escrow and the title company will take an online notarization done under another state's law is their call, so ask them before you set one up.

Should I sell with the tenant in place or wait until the lease ends?

Both work. With the tenant in place you keep the rent coming, and showings need written notice, with 24 hours presumed reasonable in California. Waiting for an empty house makes prep and showings simpler.

Who handles access for the inspector, the appraiser and buyers' agents?

Each visit is set up around your tenant's right to notice; ask Rudy how access would be arranged, and track the contract dates yourself as well.

Who needs to hear from me during the sale?

Your insurer, the property manager, the County Assessor if the homeowners' exemption is still on the bill, USPS for mail, and the HOA if there is one.

Does selling the rental restore my VA entitlement?

Usually, yes. With the house sold and the VA loan paid off, you can apply to restore the entitlement online or with VA Form 26-1880. It is separate from the closing itself, so check timing with your lender.
